Terms of Service for Instutia
These Terms of Service govern access to and use of the Instutia mobile application, website, and related services. They reflect the current intended product scope and still require founder/legal completion before a production-domain launch.
1. Eligibility and account registration
Users may access the Services only if they can enter into a binding contract and meet the minimum age that will be confirmed before production publication. Some features may require an account, and users are responsible for keeping account information accurate and credentials secure.
2. The Services
Instutia provides creator research, AI-assisted script drafting or rewriting, teleprompter and recording workflows, transcription and captioning assistance, media uploads and exports, connected-account workflows for supported third-party platforms, and potentially subscription-based premium functionality.
3. Privacy
Use of the Services is also subject to the Privacy Policy.
4. User content
Users retain ownership of their uploaded, recorded, imported, synced, or generated content, except for the limited rights granted to Instutia as needed to operate, secure, improve, and support the Services and requested features.
5. User responsibilities
- Use the Services lawfully and only with all required rights, licenses, consents, and permissions.
- Review AI-generated outputs before relying on or publishing them.
- Obtain consent where required from people whose voice, image, likeness, personal information, or content appears in uploaded material.
- Comply with platform rules, copyright law, privacy law, publicity rights, advertising rules, and other applicable laws.
6. Acceptable use
Users may not use the Services for unlawful, fraudulent, harmful, infringing, deceptive, or abusive conduct; to interfere with the Services; to bypass access controls; or to violate third-party platform rules or developer policies.
7. AI features and automated outputs
Instutia may generate drafts, scripts, captions, recommendations, and other AI-assisted outputs. Those outputs may be incorrect, incomplete, offensive, biased, outdated, or unsuitable. Users remain responsible for reviewing, editing, and deciding whether to publish or rely on them.
8. Third-party services and connected accounts
The Services may interoperate with Meta/Instagram, Google/YouTube, app stores, hosting providers, and subscription infrastructure. If users connect a third-party account, they authorize access and use of the information made available through that connection as needed to provide requested features, while remaining responsible for complying with the third party’s own terms.
9. Subscription terms
Some features may require a paid subscription or one-time purchase. Final billing intervals, free-trial terms, renewal behavior, cancellation path, and refund policy are still pending founder confirmation before production publication.
10. Intellectual property
The Services, including software, design, branding, workflows, and non-user content, are owned by Instutia or its licensors and are protected by intellectual property and other laws.
11. Feedback
Feedback, suggestions, or improvement ideas submitted to Instutia may be used without restriction or compensation unless prohibited by law.
12. Termination and suspension
Instutia may suspend, restrict, or terminate access if a user violates the Terms, creates security or legal risk, or if continued operation of a feature is no longer commercially or technically feasible.
13. Disclaimers
The Services are intended to be provided on an “as is” and “as available” basis to the maximum extent permitted by law. Instutia does not guarantee uninterrupted availability, accuracy, completeness, or fitness for a particular purpose.
14. Limitation of liability
Production liability-cap wording and jurisdiction-specific limitations are still pending founder/legal confirmation before publication.
15. Indemnity
To the extent permitted by law, users may be required to defend and indemnify Instutia against claims arising from misuse of the Services, user content, violations of the Terms, or violations of law or third-party rights.
16. Governing law and disputes
Governing-law jurisdiction and dispute venue are still pending founder/legal confirmation before production publication.
17. Changes to these Terms
Instutia may update these Terms from time to time by posting updated Terms and updating the effective date.
18. General
If any provision is found unenforceable, the remaining provisions should continue in effect to the fullest extent permitted by law. Failure to enforce any provision is not a waiver.
